Terms and Conditions
Welcome to Monk Fit. These Terms and Conditions ("Terms") govern your use of the Monk Fit mobile application (the "Application" or "Service") and your relationship with Monk Fit and Monk Hybrid Fitness Club ("we", "us", or "our").
By downloading, installing, or accessing the Service, you confirm that you agree to be bound by these Terms. If you do not agree to these Terms, you must not download, install, or use the Application. You represent that you are at least 16 years of age (or have the consent of a parent or legal guardian) to use this Service.
User Accounts
To access certain features of the Service, you must create an account ("Account"). You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your Account details to keep them accurate and complete.
- Maintain the confidentiality of your Account login credentials and password.
- Notify us immediately at our contact address of any unauthorized use or security breach of your Account.
We reserve the right to suspend or terminate your Account at our sole discretion if we suspect that any registration info is false, misleading, or violates these Terms.
App License & Usage Rules
We grant you a limited, non-exclusive, non-transferable, revocable license to download and install a copy of the Application on your mobile Device for personal, non-commercial use only.
Prohibited Activities
You agree NOT to engage in any of the following restricted activities:
- Decompile, reverse-engineer, or attempt to extract the source code of the Application.
- Use the Application for any unlawful purpose or in violation of local, state, national, or international laws.
- Attempt to bypass, disable, or interfere with security-related features of the Service.
- Upload or transmit viruses, spyware, or other malicious software code.
- Share your Account or allow others to use your personal subscription to log workouts or access training content.
Bookings, Studio Visits, and Payments
Monk Fit provides digital workout tracking and integrates with Monk Hybrid Fitness Club for physical class and session bookings.
Fees and Charges
Certain features within the Application or training programs offered at the studio require payment of subscription fees or class booking fees. All transactions are handled securely through third-party payment gateways. You agree to pay all charges incurred by your Account in accordance with billing terms in effect at the time of purchase.
Cancellation & Refund Policy
Class bookings and memberships have specific cancellation windows. Unless specified otherwise by the studio manager at the time of purchase:
- Studio class bookings must be cancelled at least 12 hours in advance to receive credit back.
- Digital subscriptions and membership fees are non-refundable but can be cancelled at the end of the billing cycle.
Physical Health & Injury Disclaimer (Waiver of Liability)
Important Medical Disclaimer
Monk Fit is not a medical organization. The fitness and health advice, workouts, step trackers, and metrics provided are for informational purposes only and cannot substitute medical consultation.
Assumption of Risk
By using the workouts or tracking your activities through Monk Fit, you acknowledge and agree that physical exercise is inherently strenuous and carries the risk of physical injury. You assume all voluntary risk associated with your training, including but not limited to sprains, cardiovascular stress, dehydration, muscle pulls, or other injuries.
Consult Your Physician
We strongly recommend that you consult with a qualified healthcare professional before beginning any new exercise routine, dietary program, or using fitness sensors. You should immediately stop any exercise and consult a doctor if you experience pain, dizziness, shortness of breath, or discomfort at any point during your workouts.
Sensor Accuracy Disclaimer
Workout data (like heart rate, steps, and active calories) pulled from device sensors via Apple HealthKit, Google Health Connect, or Bluetooth bands represent estimates only. We make no guarantee regarding the absolute accuracy, completeness, or reliability of these metrics.
Intellectual Property
The Application, including its user interface design, visual assets, software, logos, trademarks, and content (excluding user-specific workout logs), is the exclusive property of Monk Fit and its licensors. It is protected by copyright, trademark, and other laws of India and international treaties.
You may not copy, reproduce, modify, distribute, or create derivative works of any part of our intellectual property without our express, prior written consent.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Monk Fit, its directors, employees, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, loss of data, personal injury, or other intangible losses, resulting from:
- Your use or inability to use the Service.
- Any physical injuries or health conditions arising from workouts followed on the Service.
- Unauthorized access, alteration, or use of your transmissions or data.
- Any technical failure, downtime, or network connection issues.
Governing Law and Dispute Resolution
These Terms shall be governed by, construed, and enforced in accordance with the laws of India, without regard to its conflict of law principles.
Any disputes or legal claims arising out of or in connection with these Terms or your use of the Application shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.
Changes to these Terms and Conditions
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date at the top.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Application and the Service.
